Terms of Use
These Terms of Use (“Terms”) are an agreement between you and Justin P. Harper, a Massachusetts sole proprietor operating the Prayer Tracker service (“Prayer Tracker,” “we,” “us,” or “our”). They govern the Prayer Tracker mobile application, personal web app, public website, Church Suite, public church pages and forms, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
The Services
Prayer Tracker provides tools for personal prayer tracking, journaling, reminders, answered-prayer records, shared groups, and optional Personal Premium features. Church Suite provides church-owned workspaces, groups, public prayer intake, member and role administration, reporting, exports, branding, and plan-management tools.
Personal Premium and Church Suite are separate. Church-sponsored access applies only to church-owned groups explicitly assigned to a member and does not provide Personal Premium. Personal Premium does not grant access to a church or church group.
Eligibility and Accounts
The Services are intended for a general audience. You must be at least 13 years old to create an account. Prayer Tracker does not knowingly permit an account for a child under 13. Churches are responsible for having appropriate parent, guardian, or organizational authority before inviting a minor or entering information about a minor.
You must provide accurate information, maintain a valid email address when required, protect your credentials, and accept responsibility for activity under your account. Each person must use an individual account; churches and teams may not share credentials.
If you use the Services for a church or organization, you represent that you have authority to act for it and accept these Terms and the Data Processing Addendum on its behalf. A church organization is not itself a login account.
Personal Content and Shared Groups
Your personal prayers, journal entries, tags, reminders, personal groups, and personal subscription information remain separate from church administration. Church personnel cannot access personal content merely because you belong to their church.
Content you choose to place in a personal shared group may be visible to its authorized members. You are responsible for deciding what to share and for having permission to share information about another person.
Church Suite
Church groups and church content belong to the church organization, not permanently to the person who created them. The church owner controls ownership transfer and organization deletion. Owners and administrators may manage members, roles, invitations, groups, branding, billing, reports, exports, and settings according to their permissions.
Organization membership does not grant access to every church group. Group content requires an active, explicit group assignment. Owners and administrators may manage assignments without automatically receiving access to the underlying prayer content.
Churches are responsible for their ministry practices, member administration, lawful notices and permissions, handling information about minors, responses to prayer requests, and actions of their authorized representatives. Prayer Tracker does not supervise or endorse a church, ministry decision, or pastoral response.
Public Prayer Submissions and Sensitive Content
A church may offer a public or embedded prayer-request form. A person may submit without an account and may choose from available privacy or contact options. Unauthenticated submissions enter restricted review and do not publish automatically.
Authorized church reviewers may review, redact, route, publish, contact the submitter about, decline, archive, or mark a request answered according to church policy. Contact information is not published automatically.
Prayer content may reveal religious beliefs, health concerns, or other sensitive information. Do not submit unnecessary details about another person, and submit information about a minor only with appropriate authority. Prayer Tracker does not sell prayer content or use it for advertising or profiling. Submitting a request does not create a confidential professional, medical, legal, counseling, or clergy relationship with Prayer Tracker, and Prayer Tracker does not represent that the Services are subject to HIPAA.
Personal Premium Subscriptions
Personal Premium may be offered as an auto-renewing subscription through Apple App Store or Google Play, with RevenueCat supporting offer presentation and entitlement verification. The subscription name, duration, price, trial eligibility, renewal terms, and included features shown in the applicable purchase screen control your purchase.
- Payment is charged to your store account when you confirm the purchase.
- The subscription renews automatically unless you cancel through the applicable store before renewal.
- You can manage or cancel in your Apple App Store or Google Play account settings.
- Access is based on verified store and RevenueCat entitlement state, not on whether a refund was requested or issued.
- Refunds are governed by the applicable store’s policies and applicable law.
For iOS, the Apple Standard Licensed Application End User License Agreement also applies.
Church Plans and Billing
Church billing, when activated, is offered through the web administration portal and processed by Stripe Managed Payments. Purchasing is not available until Prayer Tracker activates the applicable checkout. Prayer Tracker relies on verified Stripe state for Church Plan access and does not receive full payment-card details.
Church Plan pricing, billing interval, active-group limits, trial terms, renewal details, and any applicable taxes are displayed on the website, order form, or checkout. Transaction-specific terms shown at checkout control the purchase. Taxes depend on the transaction, provider, and applicable jurisdiction.
Paid Church Plans include unlimited people and a plan-specific active-group limit. Archived groups do not count toward that limit. A Pro plan may add active-group capacity in whole blocks of five: $59 per month or $590 per year for each block, matching the base plan’s billing interval. A Pro organization may select one to four blocks, for up to 30 total active groups. Basic, Standard, and Plus plans are not eligible for this add-on.
Church billing is separate from Personal Premium. A refund is a financial event and does not by itself establish or remove entitlement; verified provider subscription state controls access.
Plan Changes, Cancellation, and Failed Payment
Church cancellation is paid through the end of the current billing period and prevents renewal. Payment failure may move the organization through grace and then read-only status without deleting content. During grace, overage, or failed-payment states, creation of groups or invitations may be restricted; export may remain available as shown in the administration portal. Reactivation may restore write access when verified provider state supports it.
Deleting an individual account does not cancel Personal Premium or a Church Plan. Requesting organization deletion requests cancellation of Church renewal at period end before the 30-day recovery period begins. Canceling an organization-deletion request does not silently reactivate billing; the owner must follow the billing controls shown in the administration portal.
Content Rights and Responsibilities
You retain your rights in content you submit. A church controls its church-owned content subject to individual privacy rights and applicable law. You grant Prayer Tracker the limited rights needed to host, process, secure, transmit, display, back up, and export content solely to operate and support the Services.
You must not submit content you lack the right to use, impersonate another person, expose private information without permission, upload malicious material, or use the Services to harass, exploit, threaten, discriminate, or violate law.
Acceptable Use and Security
You may not interfere with the Services, bypass access controls or plan limits, probe or attack systems, abuse invitations or public forms, automate spam, scrape data without authorization, reverse engineer except where law permits, or attempt unauthorized access to another account, church, group, or request.
Not an Emergency or Professional Service
Prayer Tracker is an organizational tool, not an emergency, crisis, medical, mental-health, legal, or professional counseling service. The Services do not guarantee that a person or church will review or respond to a request. If someone may be in immediate danger, contact local emergency services or an appropriate crisis resource.
Third-Party Services and Availability
The Services rely on third parties described in the Privacy Policy and Subprocessor and Service Provider List. Their terms may also apply. Prayer Tracker may update, change, limit, suspend, or discontinue features, and features may vary by platform, device, account, plan, organization status, or region.
Disclaimer
To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind. Prayer Tracker does not guarantee uninterrupted or error-free operation, delivery of notifications or emails, preservation of every item of data, or any ministry, pastoral, health, or personal outcome.
Limitation of Liability
To the fullest extent permitted by law, Prayer Tracker and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, use, goodwill, revenue, or profits arising from or related to the Services.
To the fullest extent permitted by law, total direct liability arising from or related to the Services will not exceed the greater of the fees you paid Prayer Tracker for the affected Services during the 12 months before the event giving rise to the claim or $100. These limitations do not exclude liability or remedies that cannot lawfully be excluded or limited.
Church Indemnity
To the extent permitted by law, a church organization will defend and indemnify Prayer Tracker and its operator against third-party claims arising from the church’s content, lack of required authority or permission, or misuse of Church Suite by its authorized representatives. This obligation does not apply to the extent a claim results from Prayer Tracker’s own unlawful conduct, gross negligence, or willful misconduct, and it does not limit nonwaivable rights.
Suspension, Termination, and Deletion
Prayer Tracker may restrict or terminate access to protect people or the Services, enforce these Terms, respond to misuse, nonpayment, or security risk, or comply with law. You may stop using the Services at any time.
Church-owned content may remain with the church after an individual leaves or deletes an account, with personal attribution removed where appropriate. An organization owner must transfer ownership before deleting the owner’s individual account.
Only the church owner may request organization deletion. A 30-day recovery period applies, during which the church is read-only, its public page is hidden, authorized administrators may export data, and the owner may cancel deletion. Limited billing, security, fraud-prevention, tax, accounting, deletion, or legal records may be retained as described in the Privacy Policy.
Governing Law and Disputes
Massachusetts law governs these Terms without regard to conflict-of-law rules. A claim must be brought in the state or federal courts located in Hampden County, Massachusetts, except that either party may bring an eligible claim in small-claims court. Nothing in these Terms waives applicable consumer-protection law, a nonwaivable right, or a forum available under mandatory law. These Terms do not require arbitration or waive participation in a class action where such participation is otherwise available.
General Terms
These Terms, the Privacy Policy, the Data Processing Addendum where applicable, and transaction-specific terms form the entire agreement for the Services. Transaction-specific terms control only for that transaction; the Data Processing Addendum controls for processing conflicts within its scope.
If a provision is unenforceable, the remainder remains effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; Prayer Tracker may assign them in connection with a lawful transfer of the Services while preserving applicable rights. Neither party is liable for delay caused by events beyond reasonable control. Provisions that by their nature should survive termination do survive.
Changes to These Terms
Prayer Tracker may make nonmaterial changes by posting revised Terms with a new effective date and providing notice where practical. For a material change affecting data use, ownership, billing, dispute terms, or legal rights, Prayer Tracker will seek affirmative acceptance from the affected authenticated users before applying the changed term to the affected feature where required or appropriate. Prior versions or a change summary may be requested through Support.
The English version controls where permitted by law. The Spanish version is provided as a convenience translation.
